Did You Know...?
Winning a lawsuit is just half the battle. Collecting the judgment is a separate matter. Illinois has one of the most powerful tools for enforcement of judgments available in the United States, called a Citation to Discover Assets. The Citation to Discover Assets combines several legal remedies into a single procedure, including freezing assets and compelling a defendant to appear in court to disclose their assets that can be used to satisfy the judgment. See for yourself at Section 2-1402 of the Illinois Code of Civil Procedure and Illinois Supreme Court Rule 277.
How To Protect Your Business With Litigation
For business owners dealing with legal issues, it may be time to speak with someone who knows the ins and outs of commercial litigation and collections tactics. When the stakes for your business are high, the decisions you make early on can set the tone for everything that follows, and that’s where we come in. At Madden Law LLC, we’ve handled commercial litigation and collections issues for businesses with a level of care and attention that reflects what’s truly at risk. Attorney David Madden brings over 20 years of legal experience, along with a background in high-level corporate litigation—but now he’s focusing on businesses in his local community. We’re here to help protect your business relationships, finances, and future.
Why It Pays To Prepare Before A Dispute Starts
Most business owners don’t think about business litigation until something goes sideways—a missed payment, a broken contract, a competitor stepping over the line… But we’ve seen how much easier it is to respond effectively when you’ve already laid some groundwork.
Having clear contracts, written policies, and records of communication can go a long way if you end up in court. These aren’t just legal formalities—they’re the foundation for a strong case. When you’re facing a disagreement with a vendor, a breach of agreement, or a customer who’s refusing to pay, that documentation will speak louder than any argument. There are situations where informal talks and negotiations just don’t work. Sometimes, filing a lawsuit is the best option. Whether you’re on the plaintiff or defense side, corporate litigation can protect your company’s interests when resolution isn’t happening any other way.
If you’re owed money, filing a claim may be the only way to collect. If you’re being sued, getting out ahead of the issue can prevent long-term damage. Either way, your business deserves representation that keeps your goals in focus. Our firm has helped clients throughout Chicagoland recover damages, settle disputes, and protect their business reputations for over two decades. And we do it with clear communication, practical strategies, and a respect for your time and resources.
But not every dispute ends in a trial. In fact, most cases are resolved long before then. That’s why we also focus heavily on business dispute resolution. Settlement talks, mediation, and informal agreements can sometimes provide better outcomes than taking the case to court—especially when you want to preserve a business relationship or keep matters private.
That’s why we tailor our approach to suit what your company actually needs. Some disputes require a firm response; others need a flexible touch. Whether we’re in court or at the negotiation table, we’re always focused on getting you back to running your business.
